Terms and Conditions
In these terms and conditions, ‘I’, ‘we’ or ‘us’ apply to member(s) of Merton Communications (NCMCR) where (NCMCR) refers to North Cornwall Mobile Computer Repairs. Merton Communications (NCMCR) is the trading name managed by Richard Merton.
Merton Communications (NCMCR are qualified to offer services to the Computer and Telecommunications Industry.
Quotations and Estimates
A quotation or estimate given by us is an invitation to treat and not an offer. We may withdraw or amend any quotation or estimate at any time prior to acceptance of your order, which will occur once we receive acknowledgement from you of acceptance by you.
Any advice as to the suitability of any goods for any particular purpose given by us is given without liability on our part. You are responsible for ascertaining the suitability of the goods for their purpose.
The first hour or part of spent onsite (customers premises) includes the callout fee which is subject to change in line with any increase in fuel or vehicle running costs. All additional time spent onsite is charged by the hour or part of at a reduced rate.
All work carried out off site will be estimated for prior to removal of Customers Equipment and their consent to continue..
The ‘call out’ fee is also subject to increase for additional distance or travel time required to reach the customers premises.
NCMCR reserve the right to refuse its services to Customers outside its viable operating range.
‘No Fix No Fee’
We are unable to offer this service to any of our customers as call out costs will have occurred and need to be met by the Customer. By making a verbal request for NCMCR to attend site, you agree to pay the call out fee.
NCMCR see the ‘No Fix No Fee’ service offered by some of its competitors as an opportunity to deny responsibility for any mistake they may make during a repair.
NCMCR may choose to abstain from making a repair if we feel the cost to do so would be greater than the value of the equipment in question. The repair of some older Computers may not be economically viable and we may refuse to undertake the repair, in this instance a decision to waiver the call out fee may be taken.
Terms of Payment
Payment in full is required at the time of work completion unless otherwise stated by Merton Communications (NCMCR).
All Invoices which include costs for parts are required to be paid in full within 7 days of Invoice issue.
All Invoices containing Labour costs only are required to be paid in full within 14 days of Invoice issue.
If you do not make any payment on the date due then, without prejudice to any other right or remedy to us, and whether or not any part of your account is subject to query, we will;
1)Charge you Interest at a rate of 4% above the base rate from time to time of National Westminster Bank PLC on the unpaid balance to accrue on a day to day basis from the due date for payment until receipt by us of the full amount whether before or after judgment, and
2)be indemnified by you against all costs and expenses incurred by us in recovering the sums due.
NCMCR use D.R.S Legal Services Ltd, Inc. Debt Recovery and High Court and County Court Agency Services.
All our invoices are subject to the Late Payments of Commercial Debts Act 1998 and late Payment of Commercial Debts Regulations 2002
NCMCR will always when possible make a backup of personal software data prior to carrying out a major repair or software recovery to a computer. We are unable to take responsibility for your personal data and would therefore recommend that the customer should make a data backup if preservation is critical.
